Flying Trapeze and Circus Activities Trapezium Inc at Le Château de Cirque
This document must be read and signed by anyone wishing to participate in Flying Trapeze activity or any other circus activities sponsored and operated by Trapézium Inc. at Le Château de Cirque. A parent or legal guardian must sign for any participant under the age of 18. This document has legal significance. You should be sure to read and understand it before signing.
Participation in the Activity is at the sole discretion of the Operator, and may be denied or withdrawn by Operator for any reason and at any time.
PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK
As a condition of my participation in the Flying Trapeze Activity or othe circus discipline operated by Trapezium Inc and in consideration of the opportunity to participate in such Activity, I hereby release, indemnify, and discharge the Operator of the Activity, including but not limited to Le Château de Cirque, Trapezium Inc and Cirque Carpe Diem, Karin Arseneault. their owners, officers, directors, employees, volunteers, participants, agents, representatives, and suppliers and all other persons or entities acting in any capacity on their behalf, including specifically Cirque Carpe Diem, Trapezium Inc, Le Château de Cirque, Karin Arseneault (“Operator”), on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representatives and estate, as follows:
1. I understand and acknowledge that my participation in flying trapeze or other circus disciplines such as silk, lyra, Chinese pole, contorsion, hand to hand entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. Furthermore, I understand that despite the most careful preparation, the equipment being used might malfunction. Despite any statements made by Operator or any person regarding the safety of participation in the Activity, I recognize that such participation can result in serious injury or death.
I hereby expressly accept and assume all of the risks existing in this activity, known and unknown. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.
2. I hereby release and forever discharge, indemnify and hold harmless the Operator from any and all claims, damages, losses, expenses, demands, or causes of action resulting directly or indirectly from or in any way connected with my participation in this Activity or my use of Operator’s equipment or facilities, including any such claims which allege negligent acts or omissions of Operator.
3. I declare that I am of sound mind and body, and have no health condition related to which participation in the Activity that would jeopardize my corporal integrity or well-being.
